We will always do our best to serve every customer or our services in a respectful manner, of which we kindly ask for the same. By using our site, you confirm that you accept these terms of use and that you agree to comply with them.

We have taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all goods have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods and their prices as advertised on the website.

Damage to your computer

We make every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any website accessible through it will not cause damage to your computer. It is your responsibility to ensure that the right equipment is available to use the website. We will not be liable to any person for any loss of damage which may arise to computer equipment as a result of using this website.

PURCHASE TERMS AND CONDITIONS

These are the terms and conditions on which we supply products to you. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information.

Acknowledgement and acceptance of your order

An acceptance of your order will take place when we have received the required payment in line with our terms of service.

Availability

All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available. Unapologetik Clothing is a UK based company, operating within England. All orders outside of this region will be processed and accepted on approval from the director. We reserve all rights to refuse this order, and do not accept liability to anybody for this decision.

Products may vary slightly from their pictures

The images of the products on our website are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device’s display of the colours accurately reflects the colour of the products. Your product may vary slightly from those images.

Payment terms

We will charge your account upon acceptance of the order. If it is not possible to obtain full payment for any goods then we can cancel and/or suspend any further delivery of goods to you. This does not affect any other rights you may have.

Risk and Ownership

Risk of damage to or loss of the goods passes to you at the time of delivery. However, we take advantage of numerous measures to ensure that your products are protected.

We are not responsible for delays outside our control 

If our supply of the products is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any products you have paid for but not received

Cancellation rights

Under the UK’s Distance Selling Regulations, you have the right to cancel the contract for the purchase of any item apart from items made to your specification, clearly personalised items, or items which by reason of their nature cannot be returned or are liable to deteriorate or expire rapidly. This right may be exercised at any point from the time of ordering up to and including the 14th working day after delivery.

To cancel this contract, you need to let us know CONTACT. Please state the order number and give your clear instructions to cancel the order.

If we’ve already shipped your order, you’ll need to package all the items and send them back to us at your cost. We will refund you for the items upon receipt of the returned order, and in any case within 30 days after we receive your notification to cancel.

If there is a fault with the purchase you have received, you can return them to us within 28 days of receipt.

Once returned you will be entitled to receive a refund, which will not include the cost of the original postage and packaging. We only offer refunds and do not offer an option to exchange, however once refunded you are more than welcome to re-order.

We are not able to refund or exchange items that appear to have been worn, washed.

Upon receiving your returned package we will action your requested refund and you will receive a refund confirmation by email.

Please ensure you enclose a completed returns form with your order as no form could result in your return not being accepted and processed.

Please ensure that your return is well packaged, so as to not be damaged in transit and meet returns guidelines outlined below.

All returned items must be in its original resalable condition, unworn, unwashed, complete with original tags and/or packaging if applicable.

You are responsible for the cost of returning your items.

Please note that due to hygiene reasons, bodysuits, socks and underwear cannot be returned if removed from their original packaging.

We cannot take responsibility for items damaged or lost in the return transit.

For All International Returns please email us at unapologetikltd@gmail.com to arrange the return of an order. Additional costs may be incurred.

If returning an item from outside the UK, please clearly mark the package RETURNED GOODS to avoid any customs charges. Unapologetik Clothing is NOT responsible for any return custom charges made.

A refund will be issued back to the original method of payment for the merchandise returned and can take up to 5 business days once processed. You will receive notification from us once we have actioned a refund.

Returns should be shipped with a service that provides a tracking number and insurance as we are not responsible for delayed or lost packages.

Where to find the price for the product

The price of the product (which includes VAT) will be the price indicated on the order pages when you placed your order. We take reasonable care to ensure that the price of the product advised to you is correct. However please see “What happens if we got the price wrong” for what happens if we discover an error in the price of the product you order.

We will pass on changes in the rate of VAT 

If the rate of VAT changes between your order date and the date we supply the product, we will adjust the rate of VAT that you pay, unless you have already paid for the product in full before the change in the rate of VAT takes effect.

What happens if we got the price wrong 

It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the product’s correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the product’s correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract, refund you any sums you have paid and require the return of any goods provided to you.

Which country’s laws apply to any disputes?

If you are a consumer, please note that these terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

If you are a business, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
